Bounced Cheques in the UAE: Faster Recovery for Creditors in 2026

A bounced cheque is now an executive document that can be enforced directly before the execution judge. Here is what creditors and cheque writers need to know about the current regime.

Few areas of UAE law have changed as significantly in recent years as the treatment of dishonoured cheques. Amendments to the Commercial Transactions Law largely decriminalised cheques returned for insufficient funds and, importantly for creditors, turned the bounced cheque itself into an executive document.

Direct Enforcement Before the Execution Judge

A cheque dishonoured for insufficient funds can be presented directly to the execution judge without first obtaining a judgment on the merits. This has dramatically shortened the recovery timeline: the creditor files an execution application supported by the original cheque and the bank’s return memo, and enforcement measures can follow against the debtor’s assets.

Partial Payment

Where the available balance is insufficient to cover the full cheque amount, the bank is obliged to make partial payment of whatever funds are available unless the bearer refuses. The unpaid balance remains recoverable through execution.

When Criminal Liability Still Applies

Decriminalisation is not absolute. Criminal penalties continue to apply to conduct involving bad faith, such as instructing the bank not to pay without lawful reason, closing the account or withdrawing the balance before the cheque can be presented, or deliberately signing the cheque in a way that prevents payment. Fraud-related cheque offences can still carry serious consequences, including fines and imprisonment.

Practical Steps

Creditors should present cheques promptly, retain the original instrument and return memo, and seek advice on whether execution proceedings, a civil claim or a criminal complaint best fits the circumstances. Cheque writers facing difficulties should engage early, as negotiated settlements remain possible at every stage.
